ALGEMENE VERKOOPVOORWAARDEN
1.0 Overeenkomst
Wanneer u de koper, Disneylicious (als verkoper-leverancier)de opdracht
geeft mondeling en/of schriftelijk; via e-mail,telefonisch onderhoud,of brief één of meer produkten te leveren gaan zij EEN OVEREENKOMST AAN DIE WETTELIJK BINDEND IS namelijk;
**Koop op afstand**.
U krijgt hiervan binnen 48 uur een bevestiging c.q Email/ Factuur,
met alle benodigde informatie die voor u
als klant belangrijk zijn, gebonden aan een faktuurnummer.
**Wat is een overeenkomst c.q koop op afstand?
Een overeenkomst op afstand zoals de wet die omschrijft
is een aankoop waarbij de consument en de verkoper
elkaar bij die aankoop niet hebben gezien.
Van een overeenkomst op afstand is bijvoorbeeld sprake
als u via internet of
bij een postorderbedrijf een bestelling maakt (bij onze aanbiedingen (Ebay, Marktplaats)gaat de overeenkomst pas in, na ontvangst van onze bevestiging c.q E-mail/ Factuur met bijbehorend factuurnummer!.
2.0 Levering
Disneylicious draagt zorg voor een gedegen aflevering van de bestelde
goederen. Levering geschied wel onder voorbehoud van de beschikbaarheid van deze
produkten, desnoods kan Disneylicious de overeenkomst ontbinden. De
gestelde levertijd in de webshop is slechts een indicatie, hieraan kunnen geen rechten
ontleend worden.
3.0 Aflevering
Bezorging via de post is voor rekening en risico van de koper. De TNT-verzendkosten staan
duidelijk vermeld in de webshop en op de bevestiging en tevens op uw factuur.Disneylicious is gerechtigd de bestelling
in gedeelten na te komen. De extra kosten voor nalevering neemt Disneylicious dan voor haar rekening. De koper wordt pas na betaling van het bestelde of afgeleverde produkt/en eigenaar.
4.0 Prijzen
De prijzen vermeld in de webshop zijn allen inclusief de BTW en met de grootste zorg
samengesteld, maar zijn vrijblijvend. Disneylicious kan een artikel verkeerd geprijsd hebben, of er kan een tekstfout in de omschrijving voorkomen (i.v.m het vele invoeren). Daarom kan aan de prijs, of omschrijving genoemd in deze shop, geen rechten worden ontleend.
Mits dit de bruikbaarheid/deugelijkheid van het artikel aantoonbaar ten slechte komt, dan valt deze onder 6.0 Retourzending.
5.0 Betalingen
Betaling van het factuurbedrag dient te geschieden binnen 14 dagen na ontvangst van de faktuur /e-mail datum factuuroverzicht (het origineel ontvangt u altijd afgetekend en ingesloten bij uw bestelling en is tevens uw garantiebewijs voor 3 maanden, met uitzondering van horloges met 6 maanden op het
uurwerk (glas, batterijen en polsband vallen hierbuiten). Wij behouden ons het recht bij een geconstateerde lege batterij deze vóór verzending te verwisselen,
om u een goed werkend product te kunnen leveren.
Houdt u wel rekening met enige vertraging, zodat u het artikel later ontvangt als gebruikelijk is.
- Indien de koper [binnen of buiten Nederland] niet aan de betaling voldoet (binnen deze vastgestelde termijn) zal
Disneylicious, bij 1e herinnering, gerechtigd zijn 7,50 Euro administratiekosten in rekening te brengen, bovenop uw openstaande saldo.
Wanneer Disneylicious, na aanmaning via e-mail, telefonisch of per post, ook nog een incassobureau moet inschakelen is de koper tevens deze incasso-kosten verschuldigd [ontstane Rente en Buitengerechtelijke Incassokosten bovenop het al bestaande totaalbedrag.Voor zendingen buiten de grens van Nederland gelden de buitengerechtelijke incasso tarieven buitenland die door het incassobureau gehanteerd worden.].
Ingeval van vooruitbetaling en niet nakomen van de betalingsovereenkomst en gestelde termijn hiervan,
is Disneylicious gerechtigd de overeenkomst te ontbinden en de artikelen terug te plaatsen in zijn shop, zonder tegenbericht
daar zij nog eigenaar is van het produkt c.q produkten.
Als de koper (postadres) zich buiten Nederland bevindt is deze zelf aansprakelijk voor
eventuele douanerechten en/of omzetbelasting.

géén uitwisseling van persoonlijke bankgegevens via internet nodig!
Met alle betaalmethodes houden wij deze klanteninformatie in ere.

die u op de volgende 3 manieren kunt voldoen aan Disneylicious, namelijk;
1.-Contant ( gaarne gepast) afrekenen bij ophalen van uw bestelling te Haarlem.
2.-Vooruitbetaling  overboeking

sturen wij u na het Email/ Factuur een
Disneylicious betalingsverzoek/invoice toe via email,
waarop u vervolgens,de betaling zelf kunt afronden!
6.0 Retourzending
Uitgezonderd aanbiedingen/ uitverkoop artikelen.
Retourzenden van geleverde produkten kan slechts binnen 8 dagen na ontvangst en telefonische melding. Het product moet zich dan wel in de originele en/of verzegelde), onaangebroken beschermende verpakking
bevinden (incl.de artikelkaartjes of eventueel kopie van uw factuur), anders wordt de retourzending niet
geaccepteerd. De koper draagt zorg voor de portokosten van de retourzending, mits Disneylicious anders besluit en dit aan u heeft bevestigd (per E-mail).

7.0 Garantiebepaling
Disneylicious garandeert dat het geleverde artikel voldoet aan de
normale (en volgens USA/U.K normen) eisen van deugdelijkheid,veiligheid (CE) en bruikbaarheid zoals door
Disney aan Disneylicious geleverd wordt. Bij een geconstateerde Disney
fabricagefout zal Disneylicious het artikel kosteloos vervangen.
Wanneer het artikel niet meer leverbaar is zal het aankoopbedrag geheel vergoed worden.Disneylicious geeft ook garantie op alle andere goederen als ocassions, showmodellen en vintage artikelen. De
garantiebepaling is niet van kracht op eventuele bijgeleverde batterijen [bij horloges kunt u alvorens naar de juwelier of horlogemaker eerst beter ons raadplegen, gezien de techniek van de sommige horloges],ons advies is deze
bij de nodige wissel te vervangen voor Duracell batterijen! [bij horloges; Sony of ander duurzaam merk].
8.0 Privacy
Disneylicious zal de persoonsgegevens van de koper vertrouwelijk
behandelen en nooit beschikbaar stellen aan derden.
Persoonsgegevens worden door Disneylicious alleen gebruikt voor het
uitvoeren/ afhandelen van de bestelling en het zenden van eigen (e-mail)post bij shop aanbiedingen
of nieuws [Indien aangemeld bij onze mailinglijst].
Mocht u door derden aangesproken worden, onder het gebruik van onze naam (of uit onze naam)Disneylicious, neemt u dan graag contact met ons op hierover.
9.0 Overmacht
Bij overmacht van Disneylicious kan de overeenkomst ontbonden worden.
Onder overmacht wordt verstaan: onvoorziene omstandigheden waardoor nakoming van de
overeenkomst redelijkerwijs door de wederpartij niet meer van Disneylicious kan worden verlangt zoals bijvoorbeeld bij natuurrampen, kernrampen, oorlog en
oorlogsdreiging, bedrijfsstoring, transportmoeilijkheden bij TPG Post, stakingen en wanprestatie van onze leveranciers/tussenpersonen.
10.0 Geschillen
Op alle rechtsbetrekkingen tussen Disneylicious (als verkoper-leverancier) en de koper is het Nederlandse recht van toepassing.
Alle geschillen die voortvloeien uit of verband houden met de overeenkomst waarop deze
voorwaarden van toepassing zijn zullen worden beslist door de bevoegd Nederlands rechter
in het vestigings gebied van de Disneylicious, voor zover de wettelijke bepalingen dit toestaan.

Toevoeging DISNEY GARANTIEBEPALING voor WATER en SNEEUWBOLLEN;
Leest u A.U.B de volgende afwijzing op garantie van Disney, ten overstaan van de luchtbellen
in water en sneeuwbollen. Door deze gestelde garantiebeperking naar ons geplaatst door
Disney moeten wij dezelfde garantiebeperking aanhouden naar onze klanten, die Disney
water of sneeuwbollen kopen.
Disney garantiebeperking:
Neemt u notitie van het feit dat Disney water en sneeuwbollen geen garantie verstrekt op
het vrijzijn van luchtbellen.Gedurende de productie, kunnen kleine luchtbellen zich
vasthechten aan de binnenzijde van het glas en het figuur dat binnenin geplaatst wordt,als
het met water gevuld wordt en de bol wordt dichtgesealed. Op het traject van verzending
of andere handeling, de kleine luchtbelletjes in de binnenzijde van de bol komen omhoog
naar de bovenzijde en komen daar tesamen,waar zij dan één groter luchtbel vormen,vaak
zichtbaar aan de top van de bol.
Terwijl sommige onregelmatigheden door een verandering in ontwerp of fabricage
verwijderd kunnen worden. Disney `s pogingen om luchtbellen te verwijderen/uit te sluiten
door verschillende methodes zijn tot op heden niet succesvol gebleken!.Hoe dan
ook,doordat zij de koper niet onthouden van het uiteindelijke en complete (decoratieve)
gebruik /nut van de bol,worden luchtbellen in deze hoedanigheid niet gezien als defect.
